Privacy Notice

The privacy, confidence, and trust of individuals who visit the S.C. DHEC Web site are important to us. No personal information is collected at this site unless provided voluntarily by an individual while participating in an activity that asks for the information. If you choose to provide us with personal information, as in an e-mail message, S.C. DHEC will use this information to respond to your request. There are times when your e-mail is forwarded within S.C. DHEC to employees who are better able to assist you. S.C. DHEC may also forward requests for assistance to another appropriate agency for response. Please do not put confidential and personal information such as social security number, date of birth, bank account and credit card information, mother’s maiden name or medical information in your e-mail communications to S.C. DHEC.

S.C. DHEC will not disclose personal information collected from users to private third parties unless the law requires such disclosure. Laws exist in South Carolina to ensure government is open and that the public has a right to access appropriate records and information possessed by a government agency. At the same time, however, there are exceptions to the public’s right to access certain records in order to preserve the privacy of individuals.


FAMILY PRIVACY PROTECTION

The South Carolina Department of Health and Environmental Control establishes this policy on the collection and dissemination of personal information in accordance with Sections 30-2-10 through 30-2-50 of the South Carolina Code of Laws.  The purpose of the policy is to ensure that the collection of personal information by the Department is limited to such personal information as is required and necessary to fulfill a legitimate public purpose, and to further ensure that the Department shall collect and disseminate personal information in compliance with the South Carolina Family Privacy Protection Act.

Definitions

'Personal information' - means information that identifies or describes an individual including, but not limited to, an individual's photograph or digitized image, social security number, date of birth, driver's identification number, name, home address, home telephone number, medical or disability information, education level, financial status, bank account(s) number(s), account or identification number issued by and/or used by any federal or state governmental agency or private financial institution, employment history, height, weight, race, other physical details, signature, biometric identifiers, and any credit records or reports.

'Legitimate public purpose' - means a purpose or use which falls clearly within the statutory charge or mandates of an agency, board, commission, institution, department, or other state entity.

'Commercial solicitation' - means contact by telephone, mail, or electronic mail for the purpose of selling or marketing a consumer product or service. 'Commercial solicitation' does not include contact by whatever means for the purpose of:

  1. offering membership in a credit union;
  2. notification of continuing education opportunities sponsored by not-for-profit professional associations;
  3. selling or marketing banking, insurance, securities, or commodities services provided by an institution or entity defined in or required to comply with the Federal Gramm-Leach-Bliley Financial Modernization Act, 113 Stat. 1338; or
  4. contacting persons for political purposes using information on file with state or local voter registration offices.

'Medical information’ - includes, but is not limited to, blood samples and test results obtained and kept by the Department of Health and Environmental Control pursuant to Section 44-37-30.

Collection of Personal Information

The Department shall not collect personal information beyond that which is required and necessary to fulfill a legitimate public purpose of S.C. DHEC.

Limiting Release of Personal Information

The Department shall take reasonable measures to limit release of personal information.  We have notified and instructed our staff of their responsibilities concerning the protection of personal information.  However, the South Carolina Family Privacy Protection Act requires that parties be advised that any personal information collected by the Department may be subject to public scrutiny or release.

Use For Commercial Solicitation Prohibited

Section 30-2-50 of the South Carolina Family Privacy Protection Act prohibits persons or private entities from obtaining or using any personal information obtained from the Department for commercial solicitation.  A person knowingly violating this prohibition is guilty of a misdemeanor offense and subject to the penalties specified in 30-2-50 (D).  Any person or entity requesting or obtaining records pursuant to the South Carolina Family Privacy Protection Act shall be notified of this prohibition.

In addition, each time you receive treatment or health care services at any S.C. DHEC clinic, we will offer you a copy of the current notice in effect.

COMPLAINTS

If you believe your privacy rights have been violated, you may file a complaint with the S.C. DHEC Privacy Officer or with the Department of Health and Human Services Office of Civil Rights. To file a complaint with S.C. DHEC, submit your complaint in writing to the Privacy Officer at the address listed on the first page of this Notice. All complaints must be submitted in writing. OTHER USES OF HEALTH INFORMATION

This Notice describes and gives some examples of the permitted ways your health information may be used or released. We will ask for your written permission before we use or release your health information for purposes not covered in this Notice or required by law. If you provide us written permission to use or release information, you can change your mind and remove your permission at any time by notifying the Privacy Officer in writing. If you remove your permission, we will no longer use or release the information for that purpose. However, we will not be able to take back any release that we made with your permission, and we are required to retain our records of the care that we provided to you.
